1. Agreement to Terms

By accessing or using the services provided by KD Funding ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and others who access or use the Service.

2. Financing Services

KD Funding provides access to various business purpose loans, including DSCR Loans, Bank Statement Loans, 1099 Loans, Bridge Loans, and Fix & Flip Loans. All financing is subject to credit approval, property eligibility, and underwriting requirements. Submitting an inquiry does not constitute a commitment to lend.

3. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the fitness for a particular purpose, or non-infringement. We do not guarantee that funding will be secured for every project.

4. Limitation of Liability

In no event shall KD Funding, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which KD Funding operates, without regard to its conflict of law provisions.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
